GPI may make changes to this Terms of Use and to the Website from time to time and will provide notice of these changes to each registered user of IPS by sending an email to the email address provided by the registered user. Such changes shall be effective immediately upon posting of the revised Terms of Use and each user of the Website is bound by the Terms of Use.  GPI’s most current Terms of Use may be viewed here at any time.

This Site Does Not Provide Medical Advice

The contents of the Website, such as text, graphics, images, information, and other materials (“Content”), are offered as an educational reference resource and for informational purposes only. GPI does not operate, control or supply any information, product, or service that is not clearly identified as supplied by GPI. The Content is not and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. The Website may contain health- or medical-related materials and some of the content on this Website may not be appropriate for children. Safety

We will take all reasonable steps to keep GPI safe, but we cannot guarantee it. We need your help to do that.  For safety purposes and in consideration of being allowed to use the Website, you agree not to do the following and that each of the following actions shall constitute a material breach of this Terms of Use:

    1. You will not send or otherwise post unauthorized commercial communications (such as spam) on AskDrLinda.
    2. You will not collect users’ content or information, or otherwise access AskDrLinda using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission.
    3. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on AskDrLinda.com
    4. You will not upload or distribute viruses or other malicious code.
    5. You will not solicit login information or access an account belonging to someone else or impersonate another person.
    6. You will not bully, intimidate, or harass any user.
    7. You will not post content that is hateful, threatening, pornographic, or that contains nudity or graphic or gratuitous violence.
    8. You will not develop or operate a third party application containing, or advertise or otherwise market alcohol-related or other mature content without appropriate age-based restrictions.
    9. You will not offer any contest, giveaway, or sweepstakes (“promotion”) onGPI/ AskDrLinda without our prior written consent.
    10. You will not use AskDrLinda to do anything unlawful, misleading, malicious, or discriminatory.
    11. You will not do anything that could disable, overburden, or impair the proper working of GPI/AskDrLinda, such as a denial of service attack.
    12. You will not facilitate or encourage any violations of this Statement.
    13. You will not use the Website for any purpose in violation of local, state, national, or international laws;
    14. You will not post material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others;
    15. You will not post material that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by GPI in its sole discretion;
    16. You will not after receiving a warning, continue to disrupt the normal flow of dialogue, or posting comments that are not related to the topic being discussed (unless it is clear the discussion is free-form);
    17. You will not post the same note more than once or “spam”; and
    18. You will not engage in any other conduct that restricts or inhibits any other person from using or enjoying the Website, or which, in the judgment of GPI, exposes GPI or any of its customers or suppliers to any liability or detriment of any type.

Liability

In no event shall GPI, its officers, directors, employees, shareholders, licensors, its suppliers, customers or any third parties mentioned posting material on the Website at the request of GPI be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Website or the Content, whether based on warranty, contract, tort, or any other legal theory, and whether or not GPI, its officers, directors, employees, shareholders, licensors, its suppliers, customers or any third parties mentioned posting material on the Website at the request of GPI are advised of the possibility of such damages. GPI, its officers, directors, employees, shareholders, licensors, its suppliers, customers or any third parties mentioned posting material on the Website at the request of GPI shall be liable only to the extent of actual damages incurred by you, not to exceed U.S. $1000. GPI, its officers, directors, employees, shareholders, licensors, its suppliers, customers or any third parties mentioned posting material on the Website at the request of GPI are not liable for any personal injury, including death, caused by your use or misuse of the Website or Content. Any claims arising in connection with your use of the Website, any Content, must be brought within one (1) year of the date of the event giving rise to such action occurred. Remedies under these Terms of Use are exclusive and are limited to those expressly provided for in these Terms of Use.

Termination

GPI reserves the right to review all media prior to submission to the Website and to remove any media for any reason, at any time, without prior notice, at GPI’s sole discretion. GPI may terminate any user’s right to use the Website at any time. GPI reserves the right to block, delete or stop the uploading of materials and communications that it in its sole discretion finds unacceptable for any reason.

Jurisdiction

This Terms of Use will be governed and construed in accordance with the laws of the State of Florida, without giving effect to its conflict of laws provisions or your actual state or country of residence. Any action based on or alleging a breach of this Terms of Use shall be brought only in a state or federal court located in Miami Dade County, Florida. If GPI prevails in any such action, GPI shall be entitled to also recover reasonable legal fees and costs.

General

If for any reason a court of competent jurisdiction finds any portion of this Terms of Use to be unenforceable, the remainder of the Terms of Use will continue in full force and effect.

This Terms of Use constitutes the entire Terms of Use between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous Terms of Uses, written or oral, regarding such subject matter. Any waiver of any provision of the Terms of Use will be effective only if in writing and signed by GPI.
